DELAWARE COUNTY ASSISTANT PUBLIC DEFENDER
_*REQUIREMENT: Current and Active Admission in the New York State Bar.*_ DISTINGUISHING FEATURES OF THE CLASS: The Assistant Public Defender shall represent indigent defendants charged with crimes in Town and Village Courts throughout Delaware County. The Assistant Public Defender shall also assist the Public Defender with drafting and answering County Court motions, legal research, and trial preparation. The Assistant Public Defender shall counsel and represent the defendant at every stage of the proceedings following his/her arrest and shall initiate such proceedings as in his or her judgment is necessary to protect the rights of the accused. The Assistant Public Defender shall prosecute any appeals from local Courts which are assigned by the Public Defender. In addition, the Assistant Public Defender may assign professional, technical and clerical personnel in the investigation, preparation conduct of his/her assigned cases. TYPICAL WORK ACTIVITIES: (Illustrative Only) Represents each indigent defendant who is charged with a crime as assigned by the Public Defender. Represents and counsels defendants at every stage of the proceedings following an arrest; appears at arraignment if required; initiates such proceedings which are necessary to protect the rights of the accused; reviews all discovery provided by the prosecution, drafts required motions and conducts trials when necessary, training shall be provided by the current Public Defender team when requested; prepares any local Court appeal which is warranted under existing circumstances. Candidate should expect to represent clients in Town and Village Criminal Court on a regular basis. FULL PERFORMANCE KNOWLEDGE, SKILLS ABILITIES AND PERSONAL CHARACTERISTICS: Knowledge of criminal court procedures and of the rules of evidence; some skill in the preparation of legal briefs; a desire to learn the skills necessary for presentation of a criminal case before a jury; ability to analyze, appraise and apply legal principles, facts and precedent to legal problems; good command of language; some knowledge of Criminal Law and experience in Criminal Court; initiative, and good professional judgment. _*REQUIREMENT: Current and Active Admission in the New York State Bar.*_ NOTE: A valid New York State driver's license is required at the time of employment and must be maintained at all times during employment.
